Thousands of tourist pools uncontrolled

Inspections and audits of aquatic facilities in tourist resorts continue to be lacking more than a year after the latest legislation was passed. In question is Law 61/2017 of August 01 which exempted resorts from contracting lifeguards for their pools. According to this legislation, the presence of a lifeguard became optional, provided that permanent supervision was in place, secured by a duly identified technician with first aid training. According to the National Tourist Registry, there are currently 4,426 resorts registered in Portugal. “AL” units outnumber these registrations by almost 20 fold. Despite the disparity, the rules for tourist developments continue not to apply to Local Lodging Accommodations.

New “AL” registrations double in Lisbon

Since the approval of the legislation amending the rules for Local Lodging, 836 new units have been opened in Lisbon and 297 in Porto. President Marcelo Rebelo de Sousa has already signed the bill which should be published soon, coming into force 60 days after.

Airbnb abandons New York City lawsuit

Airbnb has capitulated to lawmaker demands over its operations in New York City, agreeing to drop a legal challenge against newly passed legislation. The suit disputed a recent state law calling for fines up to $7,500 for illegally listing short-term offerings on online rental platforms such as Airbnb.

ASAE with new LL Inspection Form

The Economic and Food Safety Authority (Autoridade de Segurança Alimentar e EconómicaASAE) has developed a detailed form for agents to use when inspecting compliance requirements of Local Lodging establishments. This development marks a more active approach towards implementing current legislation.

Local Lodging Legislation adapted

The lawmakers are tweaking the fine print: Law no. 63/2015 changes certain details in the application process for Local Lodging. The new law defines the documentation when assigning the activity over to a third party. It also clarifies when more than nine units may be run by the same agent; and defines Hostels more clearly.

IMPORTANT NEWS – LL renewals

The Government is tying up some loose ends:
 
Home owners who rent out their property to tourists, have to prove to the City Hall until December 28, 2014 that they registered their activity with the Tax Office, otherwise they risk losing the Local Lodging License (Alojamento Local). 
This way, the state wants to make sure it receives taxes from all businesses.
